The social security appeals process

The Social Security disability appeal consists of four stages. They are:

  • Reconsideration stage - In this stage, you can make an appeal online requesting the SSA to review your application a second time. Only 15% of all applications submitted get approved at this stage.
  • Hearing stage - In this stage, you need to present your claim and case in front of a judge. Either you or your attorney can plead your case with the support of evidence like a doctor, witness testimony, etc. The judge may question you based on your claim to verify your disability.
  • The appeals council - If your claim gets denied at the hearing stage, you can take forth your case to a Social Security Appeals Council. The council will perform a thorough review of the judge’s decision and will decide on either approving or denying your claim.
  • Federal district court - This becomes your last and final option. Should your case face rejection in the appeals council as well, your last option is to file a lawsuit in a Federal District Court. It is extremely hard to win a claim in a federal court.
